"Among other things, the discussion regarding dual-contract structures was controversial."
Seminar leader Julia von Ah looks back on the seminar “Current Tax Issues in Real Estate” held on June 18, 2026.

Dear Julia, what was an important takeaway for you from the seminar?

  • Possible solutions regarding future deductions for maintenance costs and interest on debt for rented and leased real estate (Art. 32a, para. 1, and Art. 33, para. 1, letter a, of the New Federal Tax Act) for many practical scenarios.
  • The allocation of profits between Land AG and Werk AG in dual-contract structures requires not only extensive valuation expertise but also, depending on the type of construction project, fundamental theoretical considerations—such as whether a service provided by Werk AG to Land AG exists in dual-contract structures and, if so, how it should be justified and valued.
  • A careful analysis of several important recent Federal Supreme Court decisions on issues such as self-brokering, real estate trading, and the transfer of a large portfolio of investment properties to a stock corporation.

What surprised or delighted you the most?

There were many things that made me happy:

  • that we discussed a wide variety of scenarios for transferring privately held investment properties to a corporation,
  • that our discussion of agricultural land also covered a niche topic in which some participants were particularly interested and had come specifically to hear about, as I learned in personal conversations
  • that we had renowned experts as speakers and were able to cover a wide range of real estate topics.

Which case study was particularly controversial and why?

One of the controversial topics was the discussion regarding dual-contract structures, particularly the question of whether Land AG derives any added value from its property as a result of the planning and implementation of a development project by Werk AG under such structures. And if so, how can this be justified and estimated? The example discussed used various valuation methods to illustrate the range of possible estimates depending on the method and, above all, the scope for argumentation in individual cases.
